1. Introduction

These Terms of Use ("Terms") govern your access to and use of the Attuned Health Education platform, website, and continuing professional development (CPD) courses operated by Attuned Health Education (ABN: 80 151 940 611) ("we", "us", "our") at attunedcpd.com.au, attunedcpd.au, and attunedcpd.online ("Platform").

By accessing our Platform, creating an account, or enrolling in a course, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.

2. Eligibility

Our Platform is designed for Australian Registered Nurses seeking continuing professional development. By using our Platform, you confirm that:

You are accessing the Platform for legitimate professional development purposes
You will provide accurate information when creating your account
You are responsible for maintaining the confidentiality of your account credentials

3. CPD Courses and Content

3.1 Nature of Content

Our CPD modules are designed to support the continuing professional development of Registered Nurses in accordance with the Nursing and Midwifery Board of Australia (NMBA) standards. All content is evidence-based and reviewed against current NMBA standards and the NMBA Code of Conduct.

3.2 CPD Hours

Each module is designed to provide 2 hours of CPD activity. Allocated CPD hours are based on the estimated time required to engage with the content, complete knowledge checks, and submit CPD reflection prompts. It is your responsibility to ensure that our modules meet your specific AHPRA CPD requirements.

3.3 Not a Substitute for Clinical Advice

Our content is for continuing professional development purposes only. It does not replace clinical supervision, psychotherapy, your facility's employee assistance program, or professional medical or psychological advice. If you are experiencing significant distress, please contact the Nurse and Midwife Support helpline on 1800 667 877 or speak with your GP.

3.4 AHPRA Portfolio Records

Upon completing CPD reflection activities, a copy of your responses will be automatically emailed to your nominated email address for inclusion in your AHPRA CPD portfolio. The NMBA requires CPD records to be kept for a minimum of 5 years. You are responsible for retaining your own records.

4. Account Registration

To access our courses, you must create an account on our Platform. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Keep your password secure and not share your account credentials
Notify us immediately of any unauthorised use of your account at [email protected]

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts where we reasonably believe these Terms have been breached.

5. Pricing and Payment

Course prices are displayed on our Platform in Australian dollars (AUD). Prices are inclusive of GST only where legally required and applicable to our current tax registration status. If GST is not applicable at the time of purchase, it will not be charged or displayed on your receipt. Payment is processed securely through Stripe. By making a purchase, you authorise us to charge the payment method provided for the applicable course fees.

Prices are subject to change. Any price changes will be communicated via our Platform and will not affect purchases already completed.

6. Refund Policy

We offer a 7-day refund policy on all course purchases, subject to the following conditions:

Refund requests must be submitted within 7 days of the date of purchase
A full refund will be issued if the course has not been commenced (i.e., no lessons have been accessed)
No refund will be issued once a course has been commenced except where required under the Australian Consumer Law (such as a major failure with the platform or content that cannot be remedied).
Refund requests must be submitted to [email protected] with your name, order details, and reason for request

Approved refunds will be processed to the original payment method within 5-10 business days. This refund policy does not affect any rights you may have under the Australian Consumer Law.

7. Intellectual Property

All content on our Platform, including but not limited to course materials, text, audio scripts, video content, Field Notes PDFs, quiz questions, branding, and design, is the intellectual property of Attuned Health Education and is protected by Australian and international copyright law.

By purchasing a course, you are granted a personal, non-exclusive, non-transferable licence to access and use the course content for your own professional development purposes. You may not:

Copy, reproduce, distribute, or share course content with third parties
Use course content for commercial purposes
Modify, adapt, or create derivative works from our content
Share your account login details to allow others to access content you have purchased

8. Limitation of Liability

To the maximum extent permitted by law, Attuned Health Education and its operators exclude all liability for any loss or damage arising from your use of our Platform or content, including but not limited to:

Indirect, incidental, special, or consequential loss or damage
Loss of data, revenue, profit, or opportunity
Any reliance placed on content provided through our Platform

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law that cannot be excluded, restricted, or modified.

9. Disclaimers

Our Platform and content are provided "as is" without warranties of any kind, express or implied. While we take reasonable care to ensure the accuracy of our content, we do not warrant that:

Content is free from errors or omissions
The Platform will be available without interruption
Content will be suitable for your specific professional circumstances

Our content reflects best practice at the time of publication and is reviewed periodically. You should always apply professional judgement and refer to current NMBA standards and guidelines in your clinical practice.

Our Platform is hosted via a third-party provider (Thinkific). We do not guarantee uninterrupted access to the platform and are not liable for any temporary downtime, scheduled maintenance, or third-party server interruptions that temporarily prevent access to your modules.

10. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Victoria.

11. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of significant changes by posting the updated Terms on our Platform with a revised date. Your continued use of the Platform following notification of changes constitutes acceptance of the updated Terms.
